The Prohibition of Smoking in Certain Premises (Scotland) Regulations 2006
Earlier this year we invited comments on proposals for regulations under powers contained in the Smoking, Health and Social Care (Scotland) Bill 2005. The Bill, which prohibits smoking in certain wholly or substantially enclosed public places, was passed by the Scottish Parliament on 30 June and has subsequently received Royal Assent. It will come into force on 26 March 2006.
The regulations set out the detail and definitions of the premises to be prescribed as 'no-smoking' or exempt, signage requirements and the arrangements for fixed penalties. They have now been updated, taking into account responses to the consultation and other considerations. A copy of the regulations, which remain in draft form until they are laid before, and formally approved by, the Scottish Parliament, is attached. The updated regulations are for information only and we are not seeking further comment.

The key changes to draw to your attention are some changes in the definitions of 'no-smoking premises', including the definition of 'wholly or substantially enclosed'; clarification of signage requirements and limiting some exemptions to 'designated rooms' within premises.
