These drawings provide a suggested style only as to a form of structure for a smoking shelter which could comply with Part 1 of the Smoking, Health and Social Care (Scotland) Act 2005 ("the 2005 Act"), in terms of that structure not being "wholly or substantially enclosed" for the purposes of Part 1 of the 2005 Act. The expression "wholly or substantially enclosed" is defined or elaborated on for the purposes of Part 1 of the 2005 Act in the Prohibition of Smoking in Certain Premises (Scotland) Regulations 2006 made under that Act.
